Lindt Wins Copyright Case for Gold Bunnies

German brand Lidl has been ordered to destroy its chocolate bunnies after losing the copyright case brought on by Lindt. Switzerland’s high court has said the Lidl chocolate does not need to be thrown away but must be melted down and made into something else.

Lindt produces around 150 million of its iconic golden bunnies with red ribbons every year. They are sold in 50 countries. Lidl was offering a cheaper alternative, with green ribbon in 175 stores in the USA and thousands across Europe.

The trademark for the Lindt bunny shape was granted in 2001, and early this year, the German Federal Court also granted the shade of gold used in the foil packaging protection.
