SWISS giant Nestle has successfully challenged Cadbury’s attempt to trademark its distinctive shade of purple packaging. A UK Court of Appeal has overturned earlier support for the trademarking when it won a legal case in 2012 that meant no other chocolate company could use Pantone 2865c. Cadbury, who have been using the colour since 1905, said it was disappointed but this didn’t stop them preventing others from passing off their chocolate as Cadburys.
